1st DUI Conviction Penalties

BAC < .15% or no test results:

-Minimum 24 hours consecutive jail time (maximum 1 year) or 15 days EHM (Electronic Home Monitoring)

-$823-$5,000 fines and fees

-90 days license revocation

-Ignition interlock device until 1 year after suspension

-Alcohol/drug assessment

-Five years probation

BAC > .15% or breath test refusal:

-Minimum 48 hours consecutive jail time (maximum 1 year) or 30 days EHM (Electronic Home Monitoring)

-$1,078 to $5,000 fines and fees

- 1 year license revocation or 2 years if Refusal

-Ignition interlock until 1 year after suspension

-Alcohol/drug assessment

-Five years probation
